What is dealer license under legal Metrology Act?

When a person propose to carry on a business of buying, selling or distributing any weight or measure is required to obtain a licence from the department of legal metrology of respective state government in which it proposed to carry on such business.

A person cannot carry on business of buying, selling or distributing of any weight or measure without obtaining Dealer licence otherwise he will be liable to punishment prescribed under legal metrology Act.

Which authority issue a dealer licence?

Dealer licence is issued by controller of legal metrology Department of state government.

Who is dealer as per legal metrology Act?

Dealer means a person, who carries on, directly or otherwise, the business of buying, selling supplying or distributing any such weight or measure, whether for cash or differed payment or for commission, remuneration or other valuable consideration and includes a commission agent, an importer, a manufacturer, who sell supplies, distributes or otherwise delivers any weight or measured manufactured by him to any person other than a dealer.

Explanation:-

A manufacture who manufacture Wight or measure and sale it only to a dealer is not required to obtain a dealer licenced. However it sale to any other person other than a dealer then manufacture is also is required to obtain dealer licence
An importer importing any weight or measure and selling it only to dealer then Importer is not required to obtain any dealer licence. However it sells to any other person other than a dealer then importer is also required to obtain the dealer licence

What is procedure to obtain the dear licence?

An application along with prescribed documents to be made to the office of the inspector of legal metrology within their respective District/Civil- sub division within the respective state.
After receiving the application inspector will scrutiny all the documents and inspect the premises of the applicant and prepare an inspection report.
Inspector shall submit inspection report and document to Assistant controller of legal metrology within the prescribed time
The Assistant controller of legal metrology on receipt of application and inspection report from the inspector shall examine all the documents and inspection report and forward it along with its recommendation to the controller of legal metrology.
The controller of legal Metrology shall examine all the documents and inspection report and after considering recommendation of Assistant controller, shall grant the licence.

GST Registration certificate of company/Firm/ Sole proprietor ship

PAN/CIN/ MOA/ AOA/ of Company

PAN / Aadhar of partner In case of partnership firm

Model approval certificate

PAN / Aadhar of sole proprietor in case of sole proprietorship firm

Photo of premises

Photo of model of weight or measure

Need PAN / Aadhar of authorise representative etc.

What is the validity period of dealer licence?

Every licence issued to dealer shall be valid for a minimum period of one calendar year and may be renewed for a period of One to Five years, by the controller of legal metrology on payment of per year fee as specified in the schedule

What is the penal provision, if a person deal in weight or measure without dealer licence?

Whoever without being in possession of a valid dealer licence deal in weight or measure shall be punishable with fine which may extend to five thousand rupees and for the second or subsequent offence with imprisonment for a term which may extend to one year, or with fine, or with both.
