What is a dealer license under the Legal Metrology Act?

When a person proposes to carry on a business of buying, selling, or distributing any weight or measure are required to obtain a license from the department of legal metrology of the respective state government in which they propose to carry on such business.

A person cannot carry on the business of buying, selling, or distributing any weight or measure without obtaining a dealer license; otherwise, he will be liable to punishment prescribed under the Legal Metrology Act.

Which authority issues a dealer license?

Dealer licenses are issued by the Controller of Legal Metrology, Department of State Government.

Who is a dealer as per the Legal Metrology Act?

Dealer means a person who carries on, directly or otherwise, the business of buying, selling, supplying, or distributing any such weight or measure, whether for cash or deferred payment or for commission, remuneration, or other valuable consideration, and includes a commission agent, an importer, and a manufacturer who sells, supplies, distributes, or otherwise delivers any weight or measure manufactured by him to any person other than a dealer.

Explanation:

A manufacturer who manufactures weight or measure and sells it only to a dealer is not required to obtain a dealer license. However, if it is sold to any other person other than a dealer, then the manufacturer is also required to obtain a dealer license.

An importer importing any weight or measure and selling it only to a dealer is not required to obtain any dealer license. However, if it sells to any other person other than a dealer, then the importer is also required to obtain the dealer license.

What is the procedure to obtain the deer license?

    An application along with prescribed documents to be made to the office of the inspector of legal metrology within their respective district/civil subdivision within the respective state.

    After receiving the application inspector will scrutinize all the documents and inspect the premises of the applicant and prepare an inspection report.

    The inspector shall submit the inspection report and document to the assistant controller of legal metrology within the prescribed time.

    The assistant controller of legal metrology, on receipt of the application and inspection report from the inspector, shall examine all the documents and the inspection report and forward it along with its recommendation to the controller of legal metrology.

    The controller of legal metrology shall examine all the documents and inspection reports and, after considering the recommendation of the assistant controller, shall grant the license.

    A person cannot carry on the business of buying, selling, or distributing any weight or measure without obtaining a dealer license; otherwise, he will be liable to punishment prescribed under the Legal Metrology Act.

  • GST registration certificate of company/firm/sole proprietorship
  • PAN/CIN/MOA/AOA of Company
  • PAN/Aadhar of partner In the case of a partnership firm
  • Model approval certificate
  • PAN/Aadhar of sole proprietor in case of sole proprietorship firm
  • Photo of premises
  • Photo of model of weight or measure
  • Need PAN/Aadhar of authorized representative, etc.
