It is governed by the Cosmetics Rules, 2020 under the Drugs and Cosmetics Act, 1940. The Central Drugs Standard Control Organization (CDSCO) ensures that all imported cosmetics product meet India’s safety, quality, and labelling standards. Foreign manufacturers or their authorized Indian representatives must obtain a Registration Certificate by submitting an online application. Without this registration, importing and selling cosmetic products in India is prohibited and may attract legal penalties.

What does the term 'cosmetic' mean?

As perDrugs and Cosmetics Act, 1940,Cosmetic means any article intended to be rubbed, poured, sprinkled or sprayed on, or introduced into, or otherwise applied to, the human body or any part thereof for cleansing, beautifying, promoting attractiveness, or altering the appearance. It also includes any article intended for use as a component of cosmetic. These are the product meant for external use only and do not have medicinal effects. For example, face creams, lipsticks, perfumes, shampoos, and deodorants are all cosmetics. Even ingredients used in these products, like fragrance oils or pigments, are considered cosmetics. Unlike drugs, cosmetics are not intended to treat or cure health conditions.

Who is mandatorily required to obtain this registration?

As per the regulatory framework, the following entities are mandatorily required to obtain CDSCO registration for the import of cosmetics into India:

  1. The manufacturer himself
  2. The authorized agent of the manufacturer in India
  3. The subsidiary of the manufacturer
  4. Any other importer

Any of these parties may apply for the Registration Certificate. However, no cosmetic product can be legally imported into India without this registration, as mandated under the Cosmetics Rules, 2020.

What is the time period for Grant of Registration Certificate?

As per Rule 129C of the Drugs and Cosmetics Rules, 1945, if an application is complete in all respects and the information provided is in order, the licensing authority shall issue the Registration Certificate within six months from the date of receipt of the application. In exceptional cases, and for reasons recorded in writing, the issuance period may be extended by up to three additional months as deemed appropriate by the licensing authority. However, as per CDSCO circular, the targeted timeline for processing applications is 90 days.

What is the validity of registration certificate?

Registration Certificate (Form COS-2) issued for the import of cosmetics into India is valid for three years from the date of its issue, unless it is suspended or cancelled earlier by the licensing authority
